Do I Need to Show Grounds for Divorce? No. In Connecticut, you do not need to prove grounds for divorce. You can bring an action for divorce based on the irretrievable breakdown of your marriage.
What is an Uncontested or No Fault Divorce? A no fault divorce is a divorce that occurs when there are no disagreements between spouses over divorce related issues like custody, finances, living arrangements, spousal support, and child support.
Does it Matter That the Divorce is my Spouse's Fault? Fault can play a larger part in Connecticut divorces when fault is substantial. Did it substantially contribute to the breakdown of the marriage? Was there marital misconduct? If so, the court would determine how much weight it would give in determining issues like alimony and assignment of property. In these cases,the court will take into account the character and frequency of the misconduct, length of marriage, as well as other factors. Did the spouse hide assets? Did they use your marital income to pay for an addiction or to have an extramarital relationship? How Long Does a Divorce Take? The State of Connecticut has a 90 day required waiting period before you can divorce. Some divorces can take substantially longer depending on the issues being disputed.What is considered marital property? Marital property includes all assets acquired during the marriage, whether by gift, inheritance or through aspouse's employment.The State of Connecticut has equitable distribution. The Courts can take into account such factors as the length of your marriage, the causes for the divorce, your job skills;your age or health, the amount and source of your income, and the contribution of each of the parties in the acquisition.
